TERMS & CONDITIONS

This Terms of Service Agreement (“Agreement”) is entered into between Reality Rentals LLC (“Company”) and the User (“User”) on this date.

Services. Company provides a property management and rental property service to Users. The services include, but are not limited to, providing property listing and rental services, providing tenant screening services, and collection of rent and other funds due to the User.
Term. This Agreement shall remain in full force and effect until the User or Company terminates the Agreement.
User Responsibilities. User shall provide Company with accurate and up-to-date information regarding the rental property, including but not limited to rental rates, tenant information, and rental property maintenance. User will also be responsible for any taxes or fees associated with the rental property and will indemnify Company from any claim, liability, or cost arising from any such taxes or fees.
Company Responsibilities. Company will use commercially reasonable efforts to provide the services outlined in this Agreement. Company will also be responsible for collecting rent and other funds due to the User, and will promptly remit such funds to the User.
Fees. User shall pay Company the applicable fees for the services provided by Company. Fees are subject to change from time to time, and User will be notified of any changes.
Warranties. Company warrants that it will provide the services outlined in this Agreement in a professional and timely manner.
Indemnification. User shall indemnify and hold Company harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses arising out of or related to User’s use of the services provided by Company.
Limitation of Liability. Company shall not be liable for any direct, indirect, special, incidental, or consequential damages arising out of or related to this Agreement.
No Agency. Nothing in this Agreement shall be construed as creating an agency or other form of joint enterprise between Company and User.
Dispute Resolution. Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration pursuant to the rules of the American Arbitration Association. This is at the users expense.
Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado.
